Kanab

These Terms of Service ("Terms") govern your use of Kanab (the "App"), a mobile application that provides AI-powered furniture visualization services. By accessing or using the App, you agree to be bound by these Terms.

By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

• You must be at least 13 years old to use the App.
• You are responsible for maintaining the security of your account credentials.
• You may only use the App for lawful purposes and in accordance with these Terms.
• You retain ownership of the photos and content you upload, but grant us a license to process them to provide the service.
• Generated images are provided to you for personal, non-commercial use unless otherwise specified.

• The App uses a credit-based system. Each image generation consumes credits from your account.
• Credits can be purchased through in-app purchases or earned through promotional offers.
• All purchases are processed through Apple App Store or Google Play Store and are subject to their terms and policies.
• Credits are non-transferable and have no cash value.
• Credit expiration: Purchased credits expire 12 months after the date of purchase. Promotional or free credits may have different expiration terms.
• Pricing for credit packages is displayed in the App and may change at any time.

Refunds for in-app purchases are handled by the App Store or Google Play Store according to their respective refund policies. We do not directly process refunds. If you believe you are entitled to a refund, please contact Apple or Google support.

Credits are consumed immediately upon successful image generation. We cannot refund credits for completed generations. If a generation fails due to a technical error on our end, you may contact us at support@kanab.app to request a credit refund. Each request will be reviewed on a case-by-case basis.

You agree not to:

• Use the App to generate, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Attempt to reverse engineer, decompile, or disassemble the App or any of its components.
• Use automated systems (bots, scripts) to access the App or generate images without authorization.
• Violate any applicable laws or regulations while using the App.
• Interfere with or disrupt the integrity or performance of the App or its underlying infrastructure.
• Attempt to gain unauthorized access to the App, user accounts, or related systems.

We employ proactive AI-based content filtering to prevent the generation of inappropriate, harmful, illegal, or prohibited content. Prompts and images may be analyzed before and during generation to enforce our acceptable use policies.

We reserve the right to review, monitor, and remove content that violates these Terms or is otherwise objectionable. We may suspend or terminate accounts that repeatedly violate our policies.

The App, including its design, features, and underlying technology, is owned by Kanab and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KANAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any interruption or cessation of transmission to or from the App;
• Any bugs, viruses, or other harmful code that may be transmitted through the App; or
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content.

Our total liability to you for all claims arising from or relating to the App shall not exceed the amount of your most recent credit purchase.

You agree to indemnify, defend, and hold harmless Kanab and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any rights of another party.

We may terminate or suspend your account and access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease, and any unused credits will be permanently forfeited with no refund or compensation.

You may delete your account at any time through the App settings. Account deletion is permanent and cannot be undone. All unused credits will be forfeited upon deletion.

We reserve the right to discontinue or shut down the App at any time for any reason. In the event of a planned service shutdown, we will provide at least 14 days advance notice via in-app notification, email, or other reasonable means.

No liability for shutdown: We shall not be liable for any loss, including unused credits, resulting from the discontinuation or shutdown of the App, regardless of advance notice. All unused credits will be forfeited without refund or compensation upon service discontinuation.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Effective date" above or through the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the Sultanate of Oman, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Oman.
